The federal picture: what happened in 2026
In early 2026 the CFTC, the US regulator for derivatives, classified event contracts as swaps under federal oversight. Translation: betting-shaped questions about real events became a federally regulated financial product, not a casino game. A proposed rule published in June 2026 is still working through comment periods.
The state fights, plainly
States did not all agree that the federal picture overrides their gambling laws. As of mid-2026: the CFTC has sued Arizona, Connecticut and Illinois over enforcement; courts in Michigan, Nevada and Massachusetts have orders blocking Kalshi; and roughly thirteen states have some form of active enforcement or litigation.
